Terms of Service

1. Acceptance and scope

These Terms of Service (the “Terms”) form a legally binding agreement between you (“you”) and Icyarcanine (“Icyarcanine”, “we”, “us”), the operator of the Bramica mobile application and the website at bramica.com (together, the “Service”). By creating an account, installing the app, signing in, or otherwise accessing the Service, you confirm that you have read these Terms, the Privacy Policy, the Refund Policy, and the Acceptable Use Policy, and agree to be bound by all of them. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under the law of your country of residence. The Indian Contract Act 1872 and the Digital Personal Data Protection Act 2023 (the “DPDP Act”) define a minor as a person under 18; we do not currently offer a verified-parental-consent flow and therefore the Service is not available to minors. By using the Service you represent and warrant that you meet this age requirement.

3. Description of the Service

3.1 What the Service does

The Service provides, among other features:

• A deterministic eligibility audit that checks your stated education profile against published university and visa rules for Germany, the United Kingdom, Australia, Canada, the United States, New Zealand, Ireland, France, the Netherlands, Singapore, Norway, Italy, and Sweden;
• A side-by-side comparison of those countries on cost, recognition status, post-study work rights, and other parameters;
• An AI-assisted program search that surfaces degree programs at universities and links back to official program pages;
• Optional document-upload functionality that uses third-party AI optical-character-recognition to extract data from academic documents you upload.

3.2 The Service is an aggregator, not the source of truth

You acknowledge and agree that the Service operates as an honest aggregator of publicly available information published by third parties. Those third-party sources include, without limitation: foreign government immigration portals (e.g. UK Visas & Immigration, US Department of State, IRCC Canada, Immigration New Zealand, Department of Home Affairs Australia, BAMF Germany), the Anabin database maintained by the Kultusministerkonferenz (Germany), individual universities' admissions and international-student pages, and analogous public records of any other jurisdiction the Service covers from time to time.

Icyarcanine does not own, edit, or warrant the underlying source data. We do not have a contractual relationship with those source publishers and we have no regulatory licence to render advice. We provide a layer of structure, presentation, and search that helps you reach the official source faster. Every output of the Service either cites or links back to that source, which is the only authoritative reference.

Some features of the Service also include AI-generated output — for example, suggested university programs from a grounded AI search, automated extractions from documents you upload, and summary text in the country comparison. These outputs are generated by AI models from the underlying source data, may include errors or hallucinations, and must be verified against the cited source before they are relied on. AI-generated output is not the source of truth either; the cited source is.

3.3 Your verification obligation is integral to the Service

You acknowledge and agree that:

• government rules, university policies, fees, deadlines, and program details change without notice and may have changed since our last refresh of the underlying source;
• you retain full and independent access to every source we cite, and to all other public sources you may wish to consult;
• you assume sole responsibility for verifying every fact, figure, rule, deadline, fee, or recommendation against the official source before relying on it for any decision — including, without limitation, paying an application fee, paying a deposit, paying a consultant, making travel arrangements, leaving employment, or relocating; and
• your verification against the official source is integral to the proper use of the Service, and reliance on the Service without that verification is at your sole risk.

3.4 What the Service is not

The Service is research and information only. It is not legal advice, immigration advice, financial advice, career counselling, professional consulting, or a substitute for any of those. Nobody at Icyarcanine is licensed to render any such advice in any jurisdiction, and nothing in the Service or any communication from us should be construed as such advice or as creating any professional relationship, fiduciary duty, or duty of care.

4. Your account

You may sign in by email one-time code, Google ID token, or Apple ID token. You are solely responsible for safeguarding the email inbox, Google account, or Apple ID associated with your account; we will treat any party that completes a sign-in through one of these methods as you, and we will not be liable for activity conducted through your credentials.

You will not (a) share your account, (b) create multiple accounts to evade limits or bans, (c) sell, transfer, or sub-license your account, (d) misrepresent your identity, or (e) use the Service on behalf of another person without that person's informed consent. Breach of this section is grounds for immediate suspension and termination without notice and without refund.

5. Paid features, billing, and refunds

Bramica purchases may be processed through Razorpay, Apple App Store billing, or Google Play billing depending on platform and product availability.

5.1 Student plans (individual users)

Certain student features require a paid plan. Student plans are one-time purchases that unlock access for a fixed annual period (currently 365 days from purchase). They do not auto-renew and are not subscriptions. When the access period ends, you may purchase again or stop using paid features. Upgrading mid-year is a top-up: you pay the price difference to move to a higher tier and keep the same expiry date.

Student purchases may be processed through Razorpay (web), Apple App Store billing (iOS), or Google Play billing (Android), depending on where you buy. Icyarcanine does not collect or store your full payment-card or bank-account details; the payment processor or platform handles that step.

5.2 Counsellor plans

Counsellor workspace access is sold separately as a recurring subscription, not as a one-time student plan. Counsellor subscriptions may auto-renew at the end of each billing cycle unless you cancel at least 24 hours before renewal, using the billing channel where you subscribed (Razorpay, Apple, or Google, as offered for counsellor products). Prices may change with notice on the billing platform.

5.3 Refunds

Refunds are governed by our Refund Policy. Student one-time purchases and counsellor subscriptions follow different rules depending on how and where you paid. Icyarcanine does not issue direct refunds to your card or bank; refunds, when available, are handled by the payment rail you used.

6. Acceptable use

You agree at all times to comply with the Acceptable Use Policy, which is incorporated into these Terms by reference. We may suspend or terminate your account at our sole discretion, without notice and without refund, for any conduct we reasonably consider to be in breach of that policy.

7. Intellectual property

The Service, including the app, the website, the Bramica name and logo, the user interface, the underlying source code, the comparison data we publish, and all other materials we make available, are owned by Icyarcanine and / or its licensors and are protected by Indian and international copyright, trademark, and database-right laws. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the Service for your own non-commercial study-abroad research. No other rights are granted by implication, estoppel, or otherwise.

Your content. You retain ownership of academic documents you upload. You grant Icyarcanine a worldwide, non-exclusive, royalty-free, fully paid-up licence to store, process, copy, format, and transmit those documents (a) to provide the Service to you, (b) to apply OCR through our sub-processors as described in our Privacy Policy, and (c) to enforce these Terms. The licence terminates when you delete the document from the Service. We will not use your uploads to train any artificial-intelligence model.

Feedback. If you send us suggestions, feature requests, bug reports, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use and incorporate that feedback into the Service without attribution or compensation.

8. Third-party services, links, and outputs

The Service references and links to third-party websites, including the official websites of universities, immigration authorities, government databases (such as Anabin operated by the Kultusministerkonferenz), and information sources. We do not operate, control, endorse, or guarantee the accuracy, availability, or current state of any third-party site or the information it contains. Your interactions with any third party are solely between you and that third party.

Where the Service displays output derived from an AI system (including program results and OCR extractions from documents), the output is generated automatically, may be inaccurate or incomplete, and must not be relied upon without independent verification against the official source.

9. Disclaimers — “AS IS” basis

Because the Service is an aggregator of publicly available third-party data (see Section 3), the data is only as accurate, complete, and current as the underlying source on the day we last refreshed it. Icyarcanine does not author or independently verify that data and cannot, and does not, warrant its accuracy. The same applies to AI-generated outputs (program suggestions, OCR extractions, comparison summaries), which are derived from the underlying data and may add their own errors.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, AND ALL CONTENT, DATA, AND OUTPUTS DELIVERED THROUGH IT, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, ICYARCANINE, ITS AFFILIATES, AND ITS LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, CURRENCY, AVAILABILITY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Without limiting the generality of the foregoing, we make no representation or warranty that:

• our eligibility audit, country comparison, program search, or any other output is accurate, current, or complete;
• using the Service will result in admission to any university, the grant of any visa, residency, scholarship, or any other outcome of any kind;
• third-party sources we reference are or remain accurate or current;
• AI-generated content is free from hallucination or other inaccuracy;
• your data will never be lost, corrupted, intercepted, or inadvertently disclosed despite our use of industry-standard security measures;
• the Service will remain compatible with future device, OS, or platform versions.

You assume the entire risk arising out of your use of the Service. Any decision you make in reliance on the Service — including but not limited to applying to a university, paying an application fee, paying a deposit, paying a consultant, making travel arrangements, leaving employment, or relocating — is made at your sole risk.

10. No liability for unverified reliance

Bramica is information, not advice. We surface data we got from official government and university sources, and outputs that AI models generate from that data. We do not make data up, and we do not independently verify what the official sources publish. Sources change without notice; AI can make mistakes. Like every AI-powered product, our outputs can be wrong.

Verify before you decide. Every output of the Service comes with a link or citation back to the underlying official source. Before you act on anything you see in Bramica — paying an application fee, paying a consultant, paying a deposit, making travel arrangements, leaving employment, relocating — read the source and confirm. Your verification step is not optional.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ICYARCANINE ACCEPTS NO LIABILITY OF ANY KIND, TO YOU OR TO ANY THIRD PARTY, ARISING OUT OF OR RELATING TO YOUR USE OF, RELIANCE ON, OR INABILITY TO USE THE SERVICE; ANY ERROR, OMISSION, OR STALENESS IN THE UNDERLYING DATA OR ANY AI-GENERATED OUTPUT; OR ANY DECISION YOU MAKE IN RELIANCE ON THE SERVICE WITHOUT INDEPENDENTLY VERIFYING IT AGAINST THE OFFICIAL SOURCE WE CITED.

IN NO EVENT WILL ICYARCANINE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR ANTICIPATED SAVINGS; COST OF SUBSTITUTE SERVICES; OR DAMAGES ARISING FROM ANY ADMISSION DECISION, VISA DECISION, FINANCIAL COMMITMENT, RELOCATION, OR EMPLOYMENT DECISION YOU MAKE IN RELIANCE ON THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in this Section 10 affects any right of yours that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Icyarcanine, its directors, officers, employees, agents, affiliates, and licensors from and against any and all claims, demands, actions, proceedings, judgments, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your use of, or inability to use, the Service; (b) your breach or alleged breach of these Terms; (c) any content (including documents, profile data, and queries) you submit to the Service that infringes any third-party right or violates any law; (d) your reliance on the Service for any decision causing loss; (e) any claim brought by a third party who accessed the Service through your account; and (f) your violation of any law or regulation, including the immigration or education laws of any country. We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defence.

12. Force majeure

Neither party will be liable for any failure or delay in performance to the extent caused by an event beyond its reasonable control, including acts of God, natural disasters, epidemic, pandemic, war, terrorism, civil unrest, government action, change in law, third-party network or infrastructure outage (including the unavailability of the Apple App Store, Google Play, Supabase, or Google Cloud / Vertex AI), labour dispute, or shortage of materials. The party affected will give prompt notice and use reasonable efforts to mitigate.

13. Suspension, termination, and effect

We may suspend, restrict, or terminate your access to the Service, in whole or in part, at our sole discretion and without prior notice if (a) you breach these Terms, the Acceptable Use Policy, the Refund Policy, or any applicable law; (b) we reasonably suspect fraud, abuse, or misrepresentation; (c) continuing to provide the Service to you would expose us to material legal or reputational risk; or (d) we discontinue the Service in whole or in part. You may terminate at any time by deleting your account via the account deletion process. Sections 1, 5, 7, 8, 9, 10, 11, 12, 14, 15, 16, 17, 18, and 19 survive termination.

14. Changes to the Service and these Terms

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also amend these Terms; material changes will be posted at bramica.com/legal/terms and notified in-app. Continued use after the changes take effect constitutes acceptance. If you do not agree to a change, your sole remedy is to stop using the Service and delete your account.

15. Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of India, without regard to conflict-of-laws rules. Subject to Section 16, the courts of Mohali, Punjab, India, India will have exclusive jurisdiction; you and we consent to the personal jurisdiction of those courts and waive any objection based on venue or forum non conveniens.

16. Dispute resolution — informal then formal

Before initiating formal legal proceedings, you and we agree to attempt to resolve any dispute by sending a written notice of dispute to admin@icyarcanine.com describing the claim and the relief sought. We will respond within 30 days. Both parties will negotiate in good faith for a further 30 days. If the dispute is not resolved within that 60-day window, either party may proceed in accordance with Section 15. Nothing in this Section 16 limits any right to bring a complaint before a consumer-protection forum or a data-protection authority.

17. Apple-specific terms (iOS users only)

If you use Bramica on an Apple device, you and we acknowledge that these Terms are between you and Icyarcanineonly, and not with Apple Inc. (“Apple”). Apple is not responsible for the Service or its content, maintenance, support, warranty, product liability, intellectual property infringement claims, regulatory compliance, or consumer claims relating to the Service. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary. You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

18. Assignment, waiver, severability, no third-party rights

We may assign or transfer these Terms, in whole or in part, to any affiliate or successor of our business at any time without notice; you may not assign or transfer these Terms without our prior written consent and any attempted assignment in breach of this clause is void.

No failure or delay by either party in exercising any right under these Terms operates as a waiver of that right; any single or partial exercise does not preclude any other or further exercise.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be deemed modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' intent.

Except for Apple as expressly stated in Section 17, no person who is not a party to these Terms has any right under the Indian Contract Act 1872 or any analogous statute to enforce any provision of these Terms.

19. Entire agreement and order of precedence

These Terms, together with the Privacy Policy, the Refund Policy, and the Acceptable Use Policy, constitute the entire agreement between you and Icyarcanine regarding the Service and supersede all prior or contemporaneous understandings on the subject. In the event of any conflict between these Terms and any of those policies, these Terms prevail unless the policy in question expressly states otherwise.
